BodyTide Terms of Service
Effective and last updated: September 30, 2026 · Terms version: 2026-09-30
These Terms of Service ("Terms") govern your use of BodyTide, operated by GoodHive LLC ("BodyTide," "we," "us"). By creating an account or using BodyTide, you agree to these Terms and the Privacy Policy. If you do not agree, do not use BodyTide.
1. Eligibility and territory
BodyTide is for individuals age 18 or older who can form a binding contract. The current release is intended for use in the United States. You may not use BodyTide where doing so would violate applicable law.
2. General wellness, not medical care
BodyTide is a general-wellness and behavioral-support service that helps people notice and reflect on patterns in their own information. BodyTide is not a medical service or medical device and does not provide medical advice, diagnosis, treatment, prevention, or medication management. It is not a substitute for care from a physician, registered dietitian, mental-health professional, or other qualified professional.
Do not delay or disregard professional advice because of information in BodyTide. Talk with a qualified clinician before changing diet, exercise, supplements, or medication. If you may be experiencing a medical emergency, call 911 or your local emergency number. If food or body concerns feel distressing or hard to manage, use the support resources in the app or contact a qualified professional.
BodyTide's observations, patterns, ranges, and summaries are descriptive and may be incomplete or inaccurate. They are not predictions, prescriptions, or clinical findings.
3. Accounts
You are responsible for keeping your credentials secure, for activity under your account, and for providing accurate information. Notify support@bodytide.app if you believe your account has been used without authorization.
BodyTide may require email confirmation. You may not create an account for another person or use another person's account without lawful authority.
4. Using BodyTide independently or with a coach
The BodyTide mobile app is designed to be useful without a coach. You can use private check-ins, notes, practices, history, and personal patterns on your own.
If you choose to connect with a coach or dietitian:
- Connecting requires a short coaching profile, including your name and date of birth. A connected coach sees your age, not the date.
- You choose the categories the coach can read and may change or stop sharing at any time.
- A coach cannot change the signals you logged.
- Coach-authored targets, notes, messages, reviews, and suggestions are optional guidance you may use, skip, or revisit. They are not medical orders.
- The coach is independent and is not BodyTide's employee, agent, or clinician. BodyTide is not responsible for the coach's services, advice, professional conduct, or separate fees.
- Provider profile labels and credentials may be self-entered. Unless BodyTide explicitly says a provider has been verified, displayed credentials are not an independent verification or endorsement by BodyTide.
5. Provider terms
If you use the provider workspace, you also agree that:
- You are responsible for your licensing, scope-of-practice, professional, ethical, privacy, recordkeeping, and other legal obligations.
- BodyTide is not an electronic health record and is not offered as a HIPAA business-associate service for this release. Do not enter covered-entity protected health information or use BodyTide for covered-entity recordkeeping.
- For a connected client, you may view only information the client chose to share. You may not alter the client's logged signals.
- Before creating, importing, or maintaining a managed client's record, you must have that person's permission and any other legal authority required to collect, upload, use, and disclose the information. You are responsible for providing notices and rights required by law.
- You will not present BodyTide's descriptive summaries as a diagnosis, treatment, clinical recommendation, or medical record.
Provider access is granted after you confirm your email address and accept the provider attestation shown at registration, which is part of these Terms. BodyTide does not verify provider licenses or credentials. Provider access may be limited, suspended, or withdrawn and does not represent credential verification or endorsement unless we explicitly state otherwise.
6. Health integrations, photos, and files
Apple Health and Health Connect imports are optional and read-only. You choose permissions and initiate each sync. Revoking a device permission stops future access but does not automatically remove information already imported into your BodyTide account; use BodyTide's deletion controls for those records.
You may upload only photos, files, and information you have the right to use. Progress photos are optional. BodyTide does not analyze faces or use progress photos for biometric identification. You are responsible for reviewing files before importing them and for keeping a copy of anything you need outside BodyTide.
7. Acceptable use
You agree not to:
- Use BodyTide for an unlawful, harmful, fraudulent, or abusive purpose.
- Upload or disclose another person's information without permission and lawful authority.
- Attempt to access another person's account or data, bypass security or consent controls, probe the service, introduce malicious code, or disrupt service operation.
- Scrape, resell, sublicense, reverse engineer except where law expressly permits, or use BodyTide to build a competing service.
- Use BodyTide to provide medical care, make a clinical diagnosis, or manage medication in violation of law or professional duties.
- Misrepresent your identity, professional credentials, relationship with a client, or authority to handle data.
8. Your content and the BodyTide service
You retain ownership of information and content you provide. You grant GoodHive LLC a limited license to host, copy, process, transmit, and display that content only as needed to provide, secure, maintain, and improve BodyTide and as described in the Privacy Policy.
BodyTide and its software, design, brand, text, and other service content are owned by GoodHive LLC or its licensors. We grant you a limited, personal, revocable, non-exclusive, non-transferable license to use BodyTide for its intended purpose while these Terms apply. No other rights are granted.
Feedback you voluntarily provide may be used to improve BodyTide without compensation or obligation to you, but it will not change how we handle personal information under the Privacy Policy.
9. Current availability and purchases
The current release does not process subscriptions or payment-card information. Any future paid feature will be offered only after the applicable purchase terms, price, renewal terms, cancellation controls, and App Store requirements are in place.
BodyTide may add, change, pause, or discontinue features. We will try to give reasonable notice before a material discontinuation when practical. The service may be unavailable because of maintenance, network conditions, third-party service failures, or events outside our control.
10. App store terms
If you obtained BodyTide through Google Play, your license to the Android app is also subject to the Google Play Terms of Service. If you obtained BodyTide through Apple's App Store, your license to the iOS app is also subject to Apple's applicable App Store terms, including the Standard Licensed Application End User License Agreement. These Terms govern the BodyTide service and supplement those store terms. Neither Apple nor Google is responsible for providing the BodyTide service, support, or maintenance.
11. Disclaimers of warranties
To the maximum extent permitted by law, BodyTide is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, or uninterrupted operation.
We do not warrant that an observation, pattern, range, summary, imported record, coach statement, or other information is accurate, complete, or suitable for a decision. You are responsible for confirming anything important with an appropriate professional.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, GoodHive LLC and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from or related to BodyTide.
To the maximum extent permitted by law, our total aggregate liability for all claims related to BodyTide will not exceed the greater of the amount you paid to GoodHive LLC for BodyTide during the 12 months before the event giving rise to the claim or USD $100.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited, including liability for gross negligence, willful misconduct, or personal injury where non-waivable.
13. Indemnification
To the extent permitted by law, you will indemnify and hold harmless GoodHive LLC from third-party claims arising from your unlawful use of BodyTide, violation of these Terms, infringement of another person's rights, or information you upload without authority. Providers also agree to indemnify GoodHive LLC for third-party claims arising from their professional conduct, client relationships, or handling of managed-client information. This section does not require a consumer to indemnify us where applicable law prohibits it.
14. Suspension, termination, and deletion
You may stop using BodyTide and request account deletion at any time. We may suspend or terminate access if reasonably necessary to address a Terms violation, security threat, unlawful conduct, legal requirement, or discontinuation of the service.
Account deletion is governed by the Privacy Policy. Sections that by their nature should survive termination—including ownership, disclaimers, liability, indemnification, and dispute terms—will survive.
15. Governing law and disputes
These Terms are governed by California law, without regard to conflict-of-law rules, and applicable United States federal law. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution first
Before filing a claim, email support@bodytide.app with a description of the dispute and your contact information. We will try in good faith to resolve it within 30 days.
Binding individual arbitration
If informal resolution does not resolve the dispute, any dispute arising out of or relating to BodyTide or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and, for coordinated filings, its Mass Arbitration Supplementary Rules. A single arbitrator will hear the dispute in the county where you live, another mutually agreed location, or by video or telephone where permitted. Judgment on the award may be entered in a court with jurisdiction. You and GoodHive LLC waive the right to a jury trial. The Federal Arbitration Act governs this arbitration agreement.
Class-action waiver
Disputes must be brought only in an individual capacity, not as a plaintiff or member of a class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims except through an applicable coordinated-filing process. If this waiver is unenforceable for a particular claim, only that claim will be severed and heard in court; the remaining claims will stay in arbitration.
Public injunctive relief
Nothing in this section waives a right to seek public injunctive relief in court where a waiver is prohibited, including for California residents under *McGill v. Citibank*. A claim for public injunctive relief may be severed to court while other claims proceed in arbitration.
Coordinated filings
If 25 or more similar demands are asserted by or with the assistance of the same or coordinated counsel, they will be administered under the AAA Mass Arbitration Supplementary Rules, including applicable staged or bellwether procedures.
Small claims and arbitration opt-out
Either party may bring an eligible claim in small-claims court. You may opt out of arbitration within 30 days after first accepting these Terms by emailing support@bodytide.app from your account email with the subject "Arbitration opt-out." Opting out will not affect the rest of these Terms, and we will not retaliate for an opt-out.
Fees and court relief
For a consumer arbitration started consistently with this section, GoodHive LLC will pay AAA administrative and arbitrator fees that exceed the cost of filing the same claim in court where the AAA Consumer Rules require it. Each party otherwise pays its own legal fees unless law or the arbitrator provides otherwise. Either party may seek court relief to protect intellectual property or confidential information.
For claims that are not subject to arbitration, the state and federal courts in Orange County, California will have exclusive jurisdiction, except where applicable law permits a claim elsewhere. Nothing in these Terms waives a non-waivable consumer right or remedy.
16. Changes to these Terms
We may update these Terms as the service or law changes. We will change the date and version above and provide an in-app or email notice for material changes. If law requires affirmative agreement to a change, we will request it before the change applies.
